On January 27th 2012, the first complaint has been filed in Miami. The first 6 passengers who signed with Codacons asked 460 milions of dollars for damage compensation!

After the shipwreck of Costa Concordia, sunk near the island of Giglio, in Italy, Codacons, in collaboration with the two U.S. lawfirm Napoli Bern Ripka Shkolnik and Proner Proner LLP, launched a lawsuit in Miami, Florida U.S.A. against Carnival and Costa, aiming to get passengers compensation for all damages.

All passengers, Italians and foreigners, can still participate by filling out the following form

“This is an accident of unprecedented severity – says President Carlo Rienzi – All those who were on board the ship are entitled to be compensated not only for material damage (cost vacation, personal property lost or damaged, and any physical damage), but also to moral ones, such as fear and terror suffered, and the risks related to physical integrity. It is inadmissible, despite the sophisticated equipment on board such vessels, installed in order to avoid clashes aground, that such accidents occur ”

Obviously, the participation to this action in Miami does not preclude, if that will not be successful, a subsequent class action or individual actions in Italy, and an action for damages based on The Code of Administrative Procedure against the port authorities and other public authorities who have failed the duties controls intended to prevent such serious accident.

Adhering to the action, the passengers could become civil party to the criminal proceeding held in Grosseto, Italy too, in which CODACONS is already established as injured party to claim damages directly to captain Schettino and other officers of the cruise ship.
