Article 5 of Law 286/98states that: “A residence
permit must be issued, renewed or converted within twenty days of the date of application, if the
requisites and conditions as stipulated by the current uniform text and by the
activation regulation are present for the requested residence permit, and if
not, for another type of permit to be issued in application of the present
uniform text.”

The Law of administrative procedure, nonetheless,
provides for an extension of up to 180 days (that is, 6 months) in case the
complexity of the procedure may require it (art. 2 L. 241/90). It is not always
easy to determine this level of complexity, and it is for that reason that only
persons who been waiting for a response to their residency permit for at least
six months can participate in our complaint.

THE ITALIAN QUESTURA, IN ANY CASE, DOES NOT ALWAYS RESPECT THIS DEADLINE
PROVIDED FOR BY LAW AND LEAVES NON-EU CITIZENS WAITING FOR A RESPONSE EVEN FOR
MORE THAN A YEAR

Enough is enough, and it is now time to do something!!!

You, too, have the right to your response today!

THEREFORE, PLEASE NOTE THAT:

Codacons, together with you and other non-EU
citizens who are waiting for their residence permits, will file a collective complaint
in order to speed up your application. Our lawyers will present a group
complaint for all foreign citiziens who have requested the
issuance/renewal/conversion of their residence permit for:

Work reasons

–        
Study reasons

–        
Family reasons

and have been waiting for at least 6 months.

Therefore, if you have been waiting for a response to
your residence permit for at least 6 months

Come to our office in Rome Viale delle
Milizie n. 9 (3 Floor, Staircase C) with all documents only on days 23 – 24 –
25 – 26 – 27 September 2013 from 11.00 a.m. to 16.00 and register with Codacons’
class action, founded in favor of foreign citizens, through which we will ask
the Questura to speed up your application within the limits of the law.

Our action is free for all our members and
then you will have to pay only            
 € 50,00 for CODACONS subscribe
to.

€ 50,00 is the cost of a Codacons membership.

1)        CODACONS WILL DRAFT A CLASS ACTION LAWSUIT AND WILL
SEND IT TO THE QUESTURA TO WHICH YOU HAVE PRESENTED THE REQUEST FOR ISSUANCE/RENEWAL/CONVERSION
OF YOUR RESIDENCE PERMIT, ALLOWING A DEADLINE FOR PROCESSING OF NOVEMBER 11,
2013, AND FOR CONTACTING YOU PICK UP YOUR RESPONSE AND/OR YOUR DOCUMENTS.

2)        IF BY THE 11 OF NOVEMBER 2013 THE QUESTURA, DESPITE
CODACONS’ COMPLAINT, STILL HAS NOT CONTACTED YOU, SEND US AN EMAIL TO [email protected] FOR COMMUNICATING THE LACK OF
RESPONSE, YOUR NAME AND SURNAME, DATE AND PLACE OF BIRTH, AND WE WILL PROCEED AT
NO FURTHER COST TO YOU WITH A CLASS ACTION LAWSUIT IN THE REGIONAL
ADMINISTRATIVE COURT, THROUGH WHICH WE WILL ASK THE JUDGE TO MANDATE THAT THE
PUBLIC ADMINISTRATION GIVE YOU A RESPONSE TO YOUR RESIDENCE PERMIT.

PLEASE ALSO INFORM OTHER
FOREIGNERS WHO FIND THEMSELVES IN THE SAME SITUATION!

*Any request received after September 27, 2013 will not be
included in Codacons’ collective complaint to the appropriate Questura and the Codacons
membership fee will not be refunded. Only persons who have been waiting for a
response to their residence permit for at least 6 months may participate in the
collective complaint.

Once the application to participate in Codacons’
collective complaint has been completed, any subsequent communication will take
place through group emails addressed to those who have participated by the
deadline and in the modes indicated.
